Le Premier ministre,
Sur le rapport du ministre de l'économie, des finances et de l'industrie et du ministre de la fonction publique, de la réforme de l'Etat et de la décentralisation,
Vu la loi no 83-634 du 13 juillet 1983 modifiée portant droits et obligations des fonctionnaires, ensemble la loi no 84-16 du 11 janvier 1984 modifiée portant dispositions statutaires relatives à la fonction publique de l'Etat, et notamment son article 63 ;
Vu le décret no 84-1051 du 30 novembre 1984 pris en application de l'article 63 de la loi no 84-16 du 11 janvier 1984 portant dispositions statutaires relatives à la fonction publique de l'Etat en vue de faciliter le reclassement des fonctionnaires de l'Etat reconnus inaptes à l'exercice de leurs fonctions ;
Vu l'avis du Conseil supérieur de la fonction publique de l'Etat en date du 13 juillet 1999 ;
Le Conseil d'Etat (section des finances) entendu,
Décrète :
Modification de l'article 3 du décret précitéArt. 1er. - I. - Le premier alinéa de l'article 3 du décret du 30 novembre 1984 susvisé est remplacé par les dispositions suivantes :
« Le fonctionnaire qui a présenté une demande de reclassement dans un autre corps doit se voir proposer par l'administration plusieurs emplois pouvant être pourvus par la voie du détachement. L'impossibilité, pour l'administration, de proposer de tels emplois doit faire l'objet d'une décision motivée. »
II. - Il est ajouté au même article un alinéa ainsi rédigé :
