(LOI ORGANIQUE RELATIVE À LA NOMINATION DU PRÉSIDENT DE LA COMMISSION NATIONALE DE CONTRÔLE DES TECHNIQUES DE RENSEIGNEMENT)
Le Conseil constitutionnel a été saisi, le 25 juin 2015, par le Premier ministre, sous le numéro 2015-714 DC, conformément aux articles 46, alinéa 5, et 61, alinéa 1er, de la Constitution, de la loi organique relative à la nomination du président de la Commission nationale de contrôle des techniques de renseignement.
Le Conseil constitutionnel,
Vu la Constitution ;
Vu l'ordonnance n° 58-1067 du 7 novembre 1958 modifiée portant loi organique sur le Conseil constitutionnel ;
Vu la loi organique n° 2010-837 du 23 juillet 2010 relative à l'application du cinquième alinéa de l'article 13 de la Constitution ;
Vu la loi relative au renseignement adoptée définitivement par le Parlement le 24 juin 2015, ensemble la décision du Conseil constitutionnel n° 2015-713 DC du 23 juillet 2015 ;
Le rapporteur ayant été entendu ;
1. Considérant que la loi organique soumise à l'examen du Conseil constitutionnel comporte un article unique ; qu'elle a été prise sur le fondement du cinquième alinéa de l'article 13 de la Constitution ; que cette loi a été adoptée dans le respect des règles de procédure prévues par les trois premiers alinéas de l'article 46 de la Constitution ;
2. Considérant qu'aux termes du cinquième alinéa de l'article 13 de la Constitution : « Une loi organique détermine les emplois ou fonctions, autres que ceux mentionnés au troisième alinéa, pour lesquels, en raison de leur importance pour la garantie des droits et libertés ou la vie économique et sociale de la Nation, le pouvoir de nomination du Président de la République s'exerce après avis public de la commission permanente compétente de chaque assemblée.
