En vertu de l'article L. 41 du code des postes et des communications électroniques, l'Autorité de régulation de la communication audiovisuelle et numérique a été saisie pour avis, par courrier du 3 janvier 2022, d'un projet de modification du tableau national de répartition des bandes de fréquences en vue de son adoption par le Premier ministre.
Après en avoir délibéré le 30 mars 2022, elle émet l'avis suivant.
Le projet soumis pour avis vise à adapter l'utilisation des bandes de fréquences en cas de menaces ou de risques susceptibles d'affecter la vie de la Nation ou de mettre en cause la sécurité nationale au sens des articles L. 1111-1 et L. 1111-2 du code de la défense.
Tout d'abord, l'Autorité relève que, dans ces circonstances, le statut de plusieurs bandes de fréquences qui lui sont affectées évoluerait au profit du ministère des armées et du ministère de l'intérieur. Cette modification temporaire peut emporter des conséquences sur la diffusion ou la réception de services utilisant notamment les ondes longues, les ondes courtes (Radio France internationale, en particulier) ou la bande I de la radiodiffusion. Une coordination étroite avec ces deux affectataires de fréquences sera donc nécessaire afin d'assurer la plus grande continuité possible des services utilisant les bandes de fréquences concernées.
Par ailleurs, l'Autorité note avec satisfaction que les bandes de fréquences qui lui sont actuellement affectées pour la diffusion de la télévision numérique terrestre (TNT), de la radio en modulation de fréquence (FM) et de la radio numérique terrestre (DAB+) ne voient pas leur statut évoluer lors de la mise en place...
