Le Premier ministre,
Sur le rapport de la ministre de l'emploi et de la solidarité,
Vu le code de la sécurité sociale, notamment l'article L. 831-1 et les articles L. 835-2 et L. 851-1, dans leur rédaction issue des articles 53 et 116 de la loi no 98-657 du 29 juillet 1998 d'orientation relative à la lutte contre les exclusions ;
Vu l'article 96 de la loi de finances pour 1999 (no 98-1266 du 30 décembre 1998) ;
Vu l'avis du conseil d'administration de la Caisse nationale des allocations familiales du 9 février 1999 ;
Le Conseil d'Etat (section sociale) entendu,
Décrète :
LA LOI 98657 DU 29-07-1998 D'ORIENTATION RELATIVE A LA LUTTE CONTRE LES EXCLUSIONS A ETENDU AUX CENTRES COMMUNAUX OU INTERCOMMUNAUX D'ACTION SOCIALE (CCAS OU CIAS) LA POSSIBILITE DE PERCEVOIR L'AIDE AU LOGEMENT TEMPORAIRE (ALT),VISEE A L'ART. L851-1 DU CODE DE LA SECURITE SOCIALE,QUI ETAIT JUSQU'ALORS RESERVEE AUX SEULES ASSOCIATIONS OEUVRANT A L'INSERTION PAR LE LOGEMENT (ART. 53 DE LA LOI).PAR AILLEURS,LA LOI PRECITEE A RENDU OBLIGATOIRE LE VERSEMENT DE L'ALLOCATION DE LOGEMENT SOCIALE (ALS),DEFINIE PAR L'ART. L831-1 DU CODE DE LA SECURITE SOCIALE,AU BAILLEUR GERANT UN PARC SOCIAL DE LOGEMENTS (ORGANISMES D'HABITATIONS A LOYER MODERE) REPRESENTANT UN PATRIMOINE D'AU MOINS 10 LOGEMENTS,AFIN DE FAVORISER LE PAIEMENT REGULIER DES LOYERS ET DE CE FAIT,LA PREVENTION DES EXPULSIONS.
PAR AILLEURS,L'ART. 96 DE LA LOI DE FINANCES POUR 1999 (981266 DU 30-12-1998) COMPLETANT L'ART. 31 DU CODE GENERAL DES IMPOTS PREVOIT EGALEMENT LE VERSEMENT DE L'ALLOCATION DE LOGEMENT SOCIALE AU BAILLEUR LORSQUE CELUI-CI BENEFICIE DU REGIME FISCAL SPECIFIQUE INSTITUE DANS LE CADRE DU NOUVEAU STATUT DU "BAILLEUR PRIVE".L'AVANTAGE FISCAL ET LE VERSEMENT DE L'ALLOCATION DE LOGEMENT SOCIALE EN TIERS PAYANT S'ANALYSENT COMME UNE CONTREPARTIE EN FAVEUR DES PROPRIETAIRES BAILLEURS DE LOGEMENTS NEUFS OU ANCIENS FAISANT L'OBJET D'UNE LOCATION REMPLISSANT DES CONDITIONS TENANT AU MONTANT DES LOYERS ET AUX RESSOURCES DES LOCATAIRES.
CE DECRET ADAPTE LES DISPOSITIONS REGLEMENTAIRES RELATIVES A L'ALT ET A L'ALLOCATION DE LOGEMENT SOCIALE EN VUE DE TENIR COMPTE DU NOUVEL ORDONNANCEMENT DES DISPOSITIONS LEGISLATIVES FIGURANT DANS LE CODE DE LA SECURITE SOCIALE ET LE CODE GENERAL DES IMPOTS.
ABROGE L'ART. R831-10 (AL. 2) ET SUPPRIME LES MOTS "TOUTEFOIS" DANS SON DERNIER ALINEA.
COMPLETE PAR UN AL. LES ART. R831-11 (I,1EREMENT: A; II: A).
MODIFIE LES ART. R831-21-3,R831-21-4 (AL. 1),R831-25 (AL. 2); L'INTITULE DU LIVRE VIII ET...
