Vu la demande d'avis du ministre délégué à la poste, aux télécommunications et à l'espace reçue le 31 janvier 1997 ;
Après en avoir délibéré le 26 février 1997,
Note que l'article L. 35-1 du code des postes et télécommunications prévoit, au titre du service universel des télécommunications, la fourniture à tous d'un service téléphonique de qualité à un prix abordable. Ce service universel doit être fourni dans des conditions tarifaires prenant en compte les difficultés liées notamment au niveau de revenu de certaines catégories de personnes. A ce titre, cet article prévoit le maintien, pendant une année, en cas de défaut de paiement, d'un service restreint comportant la possibilité de recevoir des appels ainsi que d'acheminer des appels téléphoniques aux services gratuits ou aux services d'urgence au bénéfice :
- des débiteurs saisis en application de la loi no 91-650 du 9 juillet 1991 portant réforme des procédures civiles d'exécution ;
- et des débiteurs pour lesquels a été établi le plan de règlement amiable ou prononcé le redressement judiciaire civil institués par la loi no 89-1010 du 31 décembre 1989 relative à la prévention et au règlement des difficultés liées au surendettement des particuliers et des familles ;
