Marchés des valeurs mobilières: une nouvelle proposition pour modifier la directive sur le caractère définitif du règlement et la directive concernant les contrats de garantie financière

Le 24 avril 2008, la Commission européenne a présenté une proposition de texte modifiant la directive sur le caractère définitif du règlement et la directive concernant les contrats de garantie financière. Cette nouvelle proposition a pour but de renforcer la protection des systèmes de règlement et des contrats de garantie financière. La première modification envisagée vise à étendre la protection explicite de la DCDR (directive 98/26/CE concernant le caractère définitif du règlement dans les systèmes de paiement et de règlement des opérations sur titres) au règlement en période nocturne et aux systèmes liés. La proposition vise également à étendre la portée de la protection assurée par la DCDR et la DCGF (directive 2002/47/CE concernant les contrats de garantie financière)aux créances privées admissibles pour la constitution de garanties pour les opérations de crédit des banques centrales, afin de faciliter leur utilisation au sein de l'UE. Enfin, la proposition devrait permettre de simplifier et de clarifier un certain nombre d'autres éléments destinés à faciliter l'application de la DCGF et de la DCDR.
