Etude de législation comparée : les enfants nés sans vie

Le 18 avril 2008, le Sénat a publié un rapport d'étude de législation comparée sur la notion d'enfants nés sans vie. Faisant suite aux arrêts rendus par la Cour de cassation, le 6 février 2008, le rapport analyse les dispositions applicables dans neuf pays européens : l'Allemagne, l'Autriche, la Belgique, le Danemark, l'Espagne, la Grande-Bretagne, l'Irlande, les Pays-Bas et la Suisse. Ainsi, dans tous les pays étudiés, les enfants juridiquement considérés comme mort-nés sont inscrits à l'état civil. De plus la définition de l'enfant mort-né, et donc la limite légale de viabilité, résulte de la loi sauf en Allemagne, en Belgique...
