Au nom de la lutte contre le terrorisme, l'administration Bush a confirmé au Congrès américain que les agents du renseignement américain sont autorisés à utiliser des méthodes d'interrogation formellement interdites par les règles du droit international. Dans les courriers transmis au Congrès, le ministère de la justice présente donc son "interprétation juridique des conventions de Genève", soulignant "les limites de l'interrogatoire peuvent varier en fonction de l'individu détenu".
